1. Service Overview

Fotozu ("we," "us," or "Service") is a photography platform offering:

• Cloud storage for photos and galleries
• Album design and publishing tools
• Customer gallery and sharing features
• Payment processing through Razorpay
• Additional features (flipbooks, face recognition, etc.)

2. Account & User Responsibility

• Eligibility: You must be 18+ or have parental consent to use Fotozu
• Account Security: You are responsible for maintaining login credentials and all activity under your account
• Accuracy: You agree to provide accurate, current information during registration
• Notification: You'll notify us immediately of unauthorized access or security breaches
• Authorized Use: You will not share login credentials with unauthorized parties

4. Prohibited Activities

You agree NOT to:

• Violate any laws or regulations
• Upload illegal, offensive, or harmful content (hate speech, CSAM, violence)
• Infringe on third-party intellectual property rights
• Attempt to hack, bypass, or disable security measures
• Use the Service for commercial purposes without authorization
• Spam, phishing, or fraud through the platform
• Resell or redistribute the Service to others
• Harvest or scrape user data
• Upload malware or malicious software
• Impersonate others or create false identities

5. Content Policy & Moderation

• Illegal Content: We do not allow content that is illegal in India or internationally
• CSAM: Child sexual abuse material is strictly prohibited and reported to authorities
• Hate Speech: Content promoting violence, discrimination, or hatred is removed
• Harassment: Bullying, threats, and harassment are not tolerated
• Moderation Rights: Fotozu reserves the right to remove content violating this policy
• Account Termination: Repeat violations may result in account suspension or deletion

6. Intellectual Property Rights

• Fotozu retains all rights to its platform, code, design, and trademarks
• You may not reverse-engineer, decompile, or extract Fotozu's technology
• You may not use Fotozu branding without written permission
• Third-party content (fonts, icons, templates) retain their original licenses
• User-generated content belongs to the user; Fotozu has a limited license for operation

7. Payments & Billing

• All prices are in Indian Rupees (₹) and inclusive of GST (18%)
• Subscription plans auto-renew monthly unless cancelled
• You authorize Razorpay to charge your payment method on renewal dates
• Cancellation takes effect at the end of the current billing cycle
• Refunds are governed by our Refund Policy (30-day money-back guarantee)
• Failed renewal payments may result in account downgrade or suspension

8. Data Storage & Privacy

• Your data is stored on secure Vercel Blob servers (India-based)
• We use industry-standard encryption for data in transit and at rest
• Your data is not shared with third parties except for platform operation

• Data Deletion: Upon account deletion, all data is permanently removed within 30 days
• Plan Downgrade: Data exceeding free tier limits is deleted after 7 days

9. Service Availability & Uptime

• Fotozu strives for 99% uptime but does not guarantee uninterrupted service
• Maintenance windows may cause temporary downtime (announced 24h in advance when possible)
• We are not liable for data loss from power outages, attacks, or force majeure events
• Users are responsible for maintaining backups of critical data
• Service interruptions lasting 48+ hours may qualify for pro-rata refunds

To the maximum extent permitted by law:

• Fotozu shall not be liable for indirect, incidental, or consequential damages
• Our maximum liability is limited to the amount you paid for the Service
• We are not liable for data loss, business interruption, or lost profits
• Third-party links and services are not endorsed or guaranteed

12. Third-Party Services

• Razorpay: Payments processed through Razorpay per their terms
• Twilio: SMS/WhatsApp messages sent through Twilio's infrastructure
• Google Fonts & Icons: Licensed under Google Font License
• External Links: We are not responsible for third-party websites or content

14. Indemnification

You agree to indemnify and hold Fotozu harmless from any claims, damages, or costs (including legal fees) arising from:

• Your use of the Service
• Your violation of this ToS
• Your content infringing third-party rights
• Your actions or omissions

15. Dispute Resolution

• Jurisdiction: These Terms are governed by Indian law (Bangalore courts)
• Arbitration: Disputes shall be resolved through binding arbitration
• Contact First: Before legal action, contact support@fotozutech.com to resolve informally
• Consumer Rights: Nothing limits consumer protections under Indian law

16. Changes to Terms

• We may modify these Terms at any time with 30 days' notice
• Continued use after notification constitutes acceptance
• Material changes will be announced via email and in-app notification
• Substantive changes give you 30 days to cancel without penalty
